These conditions govern every use of Mingo County Criminal History, including reading its content and submitting a search to an outside provider. A visitor who does not accept the terms should stop using the website.

NO FCRA USE. This privately operated website is not connected with any government body and is not a consumer reporting agency. Neither it nor its advertising partners provides a service for credit, employment, insurance, tenant screening, or another purpose regulated by the Fair Credit Reporting Act.

1. What This Website Is

Mingo County Criminal History is an independent reference. It does not maintain official records, conduct government background checks, or file papers for a visitor. It points readers to Mingo County courts, WVDCR, the West Virginia State Police Criminal Identification Bureau, the West Virginia State Police Sex Offender Registry, police custodians, and optional outside search tools.

2. Rules for Using This Site

Use is permitted only when it is lawful and does not interfere with another person or the service.

  • Do not violate federal, West Virginia, or local law
  • Do not threaten, stalk, or harass anyone
  • Do not use the content for an FCRA-regulated decision
  • Do not bypass access controls or enter a system without permission
  • Do not scrape pages or operate automated collection tools
  • Do not overload, disable, or obstruct the website

3. No Harassment, Stalking, or Discrimination

Information found here or through a linked source may not be used to intimidate, discriminate against, stalk, or harm a person. That prohibition is especially important for registry data. The West Virginia State Police Sex Offender Registry exists for community awareness, not vigilantism or retaliation, and misuse may violate West Virginia law.

4. We Are Not a Consumer Reporting Agency

Mingo County Criminal History does not create consumer reports, credit reports, or background reports and is not a consumer reporting agency under the FCRA. A visitor must not use its content or a linked search result to make a decision about employment, housing, credit, insurance, licensing, public benefits, or any other FCRA-controlled purpose. An authorized need requires an official West Virginia State Police channel or a provider that complies with the FCRA.

5. No Legal Advice

General explanations of Mingo County warrants, cases, arrests, custody, or expungement are educational only. They do not apply law to a specific person's facts and do not replace advice from a lawyer licensed in West Virginia.

6. No Warranties

All material and services are supplied "as is." No promise is made that the content is complete, current, uninterrupted, error-free, secure, or fit for a particular need. Outside search results may also contain omissions or mistakes. Official records can change through filing, dismissal, correction, sealing, or expungement, so a Mingo County or West Virginia custodian must verify the current record.

7. Third-Party Services and Links

An external link opens a service beyond this website's control. That provider alone is responsible for its terms, data practices, content, price, uptime, and results. Review the destination's rules before using it.

8. Intellectual Property

Unless a source states otherwise, the website's original text, graphics, logos, and code belong to Mingo County Criminal History or its content partners. They may not be copied, changed, distributed, or used to make a derivative work without written permission.

9. Limits on Our Liability

To the maximum extent permitted by law, the website and its operators are not liable for a loss arising from use of, inability to use, or reliance on this service or an external service it links.

10. Indemnification

A visitor agrees to defend and hold the site and its operators harmless from claims, demands, proceedings, fees, and costs caused by that visitor's use of the service or breach of these terms.

11. Governing Law

West Virginia law governs these terms, without altering any rule that must apply by law. A dispute related to website use must be brought in a court with proper jurisdiction in West Virginia. The West Virginia Freedom of Information Act and WV Code ยง15-2-24 govern their respective government records; they do not make this private site an official record custodian.

12. Changes to These Terms

The terms may be revised at any time. A new version is effective when posted here, and later use is subject to that version.

13. Cutting Off Access

Access may be restricted or ended at any time, with or without notice, including when use creates legal, security, or operational risk.

14. Severability

If a court finds one provision invalid or unenforceable, the remaining provisions continue in effect. The affected language will be limited only as much as needed to make it enforceable.
